Emergency Ordinance no.117/2022

Emergency ordinance no. 117 published in MO no. 845 of 29.08.2022 for amending and supplementing the Law on paternity leave no. 210/1999, makes the following clarifications:

Comment: Starting with the date of this normative act, the duration of paternity leave is of ten working days, compared to five as previously provided, duration to which is added five working days of leave for those who attended a childcare course.

The 15 days paternity leave (including the additional leave for the childcare course) are granted to employees for each new-born, not just for the first born, as it was previously provided.

Also, the law imposes on employers the obligation to approve paternity leave, and those who refuse to do so may receive, from the labor inspectors, fines between 4,000 and 8,000 lei.

Employees on paternity leave cannot be fired, with the exception of situations where the employer is in judicial reorganization or bankruptcy. Companies that do not respect this prohibition risk fines between 3,000 and 10,000 lei.
