Decision no. 634/2019
 
Decision 634/2019, published in the Official Gazette Part I no. 719 of August 30, 2019, for amending Government Decision no. 34/2019 regarding the establishment of the quota of new workers admitted on the labour market in 2019, brings the following clarifications:
 
Comment: The present Decision modifies the previous legal provisions in the sense that it establishes for the year 2019 a quota of 30,000 new workers admitted on the Romanian labour market.
 
We mention that the previous law, respectively the Government Decision no. 34/2019, established a quota of 20,000 new workers admitted on the Romanian labour market. In conclusion, the current provisions supplement with 10,000 the number of new workers admitted to the Romanian labour market for 2019.
 
Law no. 124/2019
 
Law 124/2019, published in the Official Gazette Part I no. 558 of July 8, 2019 regarding the minimum requirements for increasing the mobility of employees between the Member States by improving the acquisition and retention of the supplementary pension rights,, brings the following clarifications:
 

Comment: The present law aims to facilitate the free movement rights of employees between Member States of the European Union by reducing the obstacles created by the norms that regulate the supplementary pension schemes related to the existence of an employment relationship.

The law establishes the requirements regarding the conditions for acquiring the rights related to the supplementary pension schemes, the retention of the dormant supplementary pension rights and informing the participants and the notification of participants.

This law transposes the provisions of Directive 2014/50 / EU of the European Parliament and of the Council of 16 April 2014 on the minimum requirements for increasing the mobility of workers between Member States by improving the acquisition and retention of supplementary pension rights.

Law no. 127/2019
 
Law 127/2019 published in the Official Gazette Part I no. 563 of July 9, 2019 on the public pension system, brings the following clarifications:
 
Comment: The present law comes into force on September 1, 2021, except:
 
  • Art. 86 paragraph (2) a), which enters into force on September 1, 2019 (establishing the pension point value at 1,265 lei);
  • Art. 86 paragraph (2) b), which enters into force on September 1, 2020 (establishing the pension point value at 1,775 lei);
  • Art. 139, Art. 145, Art. 148 paragraph (2), Art. 157 para. (2) and (5) and Art. 183 para. (1), come into force 3 days after the publication of this law in the Official Gazette of Romania.
Upon the date of entry into force of this law, Law no. 263/2010 on the unitary public pension systems and the Government Decision no. 257/2011 for approving the Norms for applying the provisions of the Law no. 263/2010 on the unitary public pension system are repealed.
 
Law no. 132/2019
 
Law 132/2019 published in the Official Gazette Part I no. 575 of July 15, 2019 for the amendment and supplement of Law no. 52/2011 regarding the occasional activities carried out by day laborers, brings the following clarifications:
 

Comment: Of the amendments made by this law, we mention:

  • introduction of chapter II2 regarding measures on the activity of day laborers in the field of extensive animal growing through seasonal grazing traditionally of sheep, goats or cattle in a semi-free manner;
  • supplement of Art. 13 paragraph (1) f) with the field of activity – camps for children organised by the Ministry of Youth and Sports, directly or through its subordinated units – class 5520.
