Law No. 215/2019

Law no. 215/2019, published in the Official Gazette Part I no. 921 of November 14, 2019, amending and supplementing Law no. 263/2010 on the unitary public pension system, brings the following clarifications:

Comment: This law amends the provisions of Art. 18 paragraph a), in the sense that for periods subsequent to April 1, 2001, representing, according to the law, contributions from work carried out under special or particular conditions, additional periods are granted to the length of service, which constitute contribution periods under normal working conditions, respectively a number of 4 months for each year worked under special working conditions.

We mention that the previous law established a number of 3 months added to the length of service, for the work performed under the aforementioned conditions.

At the same time, this Law also provides for changes in the way in which the standard retirement age (for the age limit) is reduced in the case of individuals who have carried out their activity under special working conditions.

Law No. 214/2019

Law no. 214/2019 published in the Official Gazette Part I no. 924 of November 15, 2019, supplementing Art. 3 of Law no. 61/1993 regarding the state allowance for children, brings the following clarifications:

Comment: Starting with January 1, 2020, the amount of the state allowance for children is increased annually by 100% from the average annual inflation rate.

Order 3175/1308/2019

Order no. 13175/1308/2019, published in the Official Gazette Part I no. 841 of October 16, 2019, on establishing the value of the monthly indexed amount granted as childcare vouchers for the second semester of 2019.

Comment: This order establishes that for the second semester of 2019, starting with October 2019, the amount of the monthly amount to be given as childcare vouchers is of 460 lei.

The nominal value set for the first two months of the first half of 2020, respectively February 2020 and March 2020 (we mention that in accordance with the implementing rules of GIA no. 165/2018 regarding the granting of value tickets, the semester consists of 6 full calendar months, starting with February 2019).

Order 1567/915/2019

Order 1567/915/2019 published in Official Gazette Part I no. 857 of October 23, 2019 regulating certain measures within the social health insurance system regarding the implementation of the provisions of Art. V of Government Ordinance no. 17/2015 on regulating certain fiscal and budgetary measures and amending and supplementing certain normative acts, brings the following clarifications:

Comment: The Order establishes that providers of medical services, pharmaceutical products and medical devices, as well as providers of medical services, pharmaceutical products, specific sanitary materials, medical devices and similar, granted under national curative healthcare programs — natural persons, legal persons under private law, entities without legal personality or legal persons under public law — do not have the obligation to apply the stamp on statements, applications, contracts or any other documents or records submitted to the health insurance houses or issued in connection or concluded with the health insurance houses.

At the date of entry into force of this order, any legal provisions contrary to the provisions of paragraph 1 presented above shall cease to apply within the social health insurance system.
