Emergency Ordinance no. 8/2018
Emergency Ordinance no. 8/2018, published in the Official Gazette Part I no. 190 of March 1, 2018, regarding the regulation of certain healthcare measures, brings the following clarifications:
Comment: This Emergency Ordinance brings important changes for employers and employees:
ü Until July 1, 2018, the minimum contribution period in order to benefit of sick leave and of related allowances is of 1 month in the last 12 months preceding the month for which sick leave is granted;
ü The CAS calculation method for sick leave allowances is herein amended. Until June 30, 2018 (respectively September 30, 2018 for maternity leave, maternal risk, and sick child care), the CAS related to sick leave allowance shall be capped at 10.5% x35% x3131 lei versus the number of working days of sick leave. After the aforementioned period, it is reverted to the calculation method required by Government Emergency Ordinance 3/2018 concerning certain fiscal-budgetary measures.
Employers who have calculated and paid sick leave allowances in 2018, prior to the entry into force of this Ordinance, shall submit Amending Statements and shall pay the differences related to said allowances to the entitled individuals by March 31, 2018.
