Law no. 47/2019
Law no. 47/2019, published in the Official Gazette Part I no. 196 of March 12, 2019, regarding the state social insurance budget for 2019, brings the following clarifications:
Comment: The Law regarding the state social insurance budget also includes the following aspects:
- The gross average earnings used to substantiate the state social insurance budget for 2019 is 5,163 lei.
- The amount of the death grant shall be established, in accordance with the law, in the case of: a) the insured person or the pensioner, at 5,163 lei; b) of a family member of the insured or the pensioner, to 2.582 lei.
- Starting with the date of entry into force of this law and until December 31, 2019, are not granted the loans, respectively the non-reimbursable funds provided under art. 86 and 861 of Law no. 76/2002 on the unemployment insurance system and employment stimulation, with subsequent amendments and supplements.
Law no. 50/2019
Law no. 50/2019, published in the Official Gazette Part I no. 209 of March 15, 2019, regarding the state budget for 2019, brings the following clarifications:
Comment: For the fiscal year 2019, this law provides and authorises incomes by chapters and sub-chapters and expenditures depending on destination and the main credit officers for the state budget, for the Single National Health Insurance Fund (CASS), foreign credits, foreign non-reimbursable funds and activities fully-funded from own income.
Emergency Ordinance no. 9/2019
Emergency Ordinance no. 9/2019, published in Official Gazette Part I no. 143 of February 22, 2019, for amending and supplementing Law no. 61/1993 regarding the state allowance for children, as well as for the amendment of art. 58 par. (1) of the Law no. 448/2006 regarding the protection of rights of persons with disabilities, brings the following clarifications:
Comment: This Emergency Ordinance amends and supplements the following normative acts as follows:
- Article 3, paragraph (1) of the Law no. 61/1993 regarding state allowance for children shall be modified and shall have the following content: “Art. 3. – (1) The state allowance for children shall be established in the amount of:
a) 300 lei for children aged up to 2 years or up to 3 years, in the case of children with disabilities;
b) 150 lei for children aged between 2 years and 18 years, as well as for young people stipulated in art. 1 par. (3);
c) 300 lei for children between the ages of 3 and 18, in the case of disabled children”.
We mention that these provisions apply starting with the rights related to the month after the entry into force of the State Budget Law for 2019.
- Paragraph (1) of Art. 58 of the Law no. 448/2006 with regard to the protection and promotion of handicapped persons, shall be modified and shall have the following content: “Art. 58 – (1) Children with disabilities, including children with HIV / AIDS, benefit from state allowance under the conditions and in the amount stipulated by the law.”
Decision no. 171/2019
Decision no. 171/2019, published in the Official Gazette Part I no. 249 of April 1, 2019, on establishing April 30, 2019 as a legal holiday, brings the following clarifications:
Comment: This Decision establishes that for personnel of public institutions and authorities April 30, 2019 shall be a legal day off. In order to recover this working day, the public institutions and authorities will extend their working hours accordingly until May 31, 2019, according to the established working schedule.

Comment: This decision regulates the accreditation criteria for brokerage agencies regarding the daily-work supply and demand, the accreditation and notification procedure, the suspension and withdrawal of accreditation, and the right to provide brokerage services between the daily-work supply and demand and the obligations of the authorized intermediary agencies for the daily-work supply and demand.
