Order No. 596/2021

Order no. 596/2021 published in the Official Gazette 673 of July 08, 2021 regarding the approval of the template of the request and the documents listed in Art. 1 paragraph (1) letter b) and d) of the Government Emergency Ordinance no. 132/2020 regarding support measures for employees and employers in the context of the SARS-CoV-2 pandemic, as well as for stimulating employment growth, brings the following clarifications:

Comment: This Order modifies and approves the template of the request form, of the affidavit and of the list, provided in Art.1 1 paragraph (1) letter b) and d) of the Government Emergency Ordinance no. 132/2020 on support measures for employees and employers granted in the context of the SARS-CoV-2 pandemic, as well as for stimulating employment growth.
The templates of the documents are annexed to this Order.

Order No. 595/2021

Order no. 595/2021 published in the Official Gazette 681 of July 09, 2021 regarding the approval of the template of the request and the affidavit for requesting the allowance stipulated in Art. 3 of Government Emergency Ordinance no. 132/2020 regarding support measures for employees and employers in the context of the SARS-CoV-2 pandemic, as well as for stimulating employment growth, brings the following clarifications:

Comment: This Order amends and approves the template of the request and the affidavit for professionals defined in Article 3 of the Emergency Ordinance No. 132/2020, for persons who have concluded individual employment agreements under Law No. 1/2005 and for persons who earn income from copyright and related rights.

Order No. 4050/2021

Order no. 4050/2021 published in the Official Gazette 688 of July 12, 2021 for the approval of the Methodological Norms regarding the annual leave for academic staff with teaching, management, guidance and verification roles and for the research staff in the state education system, brings the following clarifications:

Comment: This Order approves the Methodological Norms regarding the annual leave for academic staff with teaching, management, guidance and verification roles and for the research staff in the state education system. On the date of entry into force of this Order, the Order of the Minister of Education, Research, Youth and Sports no. 5559/2011 for the approval of the Methodological Norms regarding the annual leave for academic staff in the educational system is repealed.

Order No. 585/2021

Order no. 585/2021 published in the Official Gazette 712 of July 19, 2021 for the amendment and supplement of the framework template of the individual employment contract, provided in the Annex to the Order of the Minister of Labour and Social Solidarity no. 64/2003, brings the following clarifications:

Comment: This Order amends and supplements the framework template of the individual employment contract, as follows:

  • Letter F “Job responsibilities” shall have the following content.
    F. Job responsibilities
    The job responsibilities are provided in the job description, annex to the individual employment contract, with the exception of micro-enterprises with up to 9 employees, as defined in Art. 4 paragraph (1) letter a) of Law no. 346/2004 regarding the stimulation of the creation and the development of small and medium enterprises, with subsequent amendments and supplements, that will provide a short characterization / description of the activity: …………………………………………………… …
  • The obligations of the employer referred to in letter M point (4) are supplemented by inserting after leter c) a new letter c^1, with the following content:
    “c^1 to inform the employee about the obligation to enrol in a private pension fund;”
