Emergency Ordinance No. 20/2022

Emergency Ordinance no. 20 of March 07, 2022 published in the Official Gazette no. 231 of March 08, 2022 amending and supplementing certain normative acts, as well as for establishing of support and humanitarian assistance measures, brings the following clarifications:

Comment: In addition to other provisions imposed by this emergency ordinance, the normative act provides in Article VI that Ukrainian citizens who have legally entered Romania and who do not apply for a form of protection (asylum), can be employed without an employment permit. These persons are extended the right to stay for work purposes according to the Government Emergency Ordinance no. 194/2002 on the legal status of foreigners in Romania, without the obligation to obtain a long-stay visa for employment.

Ukrainian citizens who come from the armed conflict zone of Ukraine and who do not have documents to prove the professional qualifications and experience required to obtain a certain job, can be employed for 12 months, with the possibility of extension to 6 months, up to maximum one year based on an affidavit where they state that they meet the professional qualifications required for the job, that they have no criminal record incompatible with the activity they carry out/shall carry out in Romania.

The employment procedure for these persons shall be approved by order of the Minister of Labour and Social Solidarity within 5 working days of the entry into force of this Emergency Ordinance.

These provisions do not apply to Ukrainian citizens wishing to enter or practice in Romania the profession of doctor, dentist, pharmacist, general medical assistant, midwife, veterinary surgeon, and architect or one of the professions listed in Annexes 2, 4, 8 of Law no. 200/2004 on the recognition of regulated professions in Romania.

Order No 301 of March 9, 2022 published in the Official Gazette no. 240 of March 10, 2022, approving the procedure for the employment of Ukrainian citizens coming from the armed conflict zone of Ukraine, brings the following clarifications:

Comment: The procedure for the employment of Ukrainian citizens coming from the armed conflict zone of Ukraine is approved and is established the template for the affidavit that can be used for the employment of Ukrainian citizens.
