Law no. 104/ 20.04.2022 published in the Official Gazette no. 391 of April 21, 2022 amending Art. 13 para. (1) letter i) of Law no. 52/2011 regarding the performance of occasional activities by day workers, republished in the Official Gazette no. 947 of December 22, 2015, brings the following clarifications:
Comment: In Article 13 para. (1) letter i) is amended to read as follows: “i) landscape maintenance activities – planting, care and maintenance of parks and gardens, except private housing facilities, as well as maintenance of green spaces in the public domain of administrative-territorial units – class 8130”.
Order no. 1165/218/2022
Order no. 1165/218 of April 15, 2022 published in the Official Gazette no. 378 of April 15, 2022 amending and supplementing the Order of the Minister of Health and the President of the National Health Insurance House no. 1092/745/2020 approving the standard template of the medical leave certificate, its instructions of use and filling out, based on which are granted the social health insurance benefits and those for accidents at work and occupational diseases, brings the following clarifications:
Comment: This Order approves the standard template of the medical leave certificate and its instructions of use. The medical leave certificates in the current format until the date of entry into force of this order shall be used until the they are out of stock, but not later than December 31, 2022. Thus, is introduced a new type of medical leave — Leave for the care of patients with oncological diseases (allowance code 17) and a special type of childcare leave — Leave for the care of a child who is quarantined due to an infectious disease (allowance code 92).
Order no. 1166/217/2022
Order no. 1166/217 of April 15, 2022 published in the Official Gazette no. 378 of April 15, 2022 amending and supplementing the application rules of the provisions of Government Emergency Ordinance no. 158/2005 on medical leaves and social health insurance allowances, approved by the Order of the Minister of Health and of the President of the National Health Insurance House no. 15/2018/1311/2017, brings the following clarifications:
Commentary: This Order brings a series of new changes regarding patients with oncological diseases and medical certificates that are issued in such situations as well as news regarding insured persons whom are not required to quarantine or isolate and who have the right to leave and indemnity for the supervision and care of children aged up to 18 years, who are obliged to quarantine or isolate under Law no. 136/2020, republished, with subsequent amendments and supplements. At the same time, this order also sets out the template of agreement that the patient with oncological diseases can express for one person, for each treatment or surgery.
